I’m in the U.S. on an H-1B, which my employer recently extended. However, I don’t have an H-1B visa stamp in my passport because I originally had a change of status from F-1 STEM OPT. As a result, I could face difficulties traveling outside of the U.S., working for another company, or even returning to my home country if I ever leave my current job.
Although I miss my family terribly and would love to see them again soon, I worry about the delay in obtaining my H-1B visa for work in the United States. With current procedures, it could take upwards of six months to receive a response from the U.S. government approving my visa application, which is significantly longer than the three-month processing time usually allotted for H-1B visas. This added uncertainty combined with how much I have changed since my last visit (currently a full-time student) makes me hesitant to try and relocate overseas again anytime soon.
If you are eligible for a visa interview waiver, your application can be submitted from the U.S. This year. The waiting time to obtain a visa interview is approximately six weeks, but this wait time may be shorter during high demand periods. As of July 1, 2018, the United States Visa Application Process has been Simplified with the launch of the e-Verify system. This change will make it easier for applicants to understand and complete their visa application.

Many people think that the situation is slow to change and the current status quo might even remain in effect after this March’s upcoming H-1B visa lottery. This is because obtaining a visa can be so risky, and many people who have renewed their visa or changed to another visa category have put off traveling abroad for fear of not being able to promptly return to the U.S. We still advise our clients who need visas to avoid international travel if possible, but this isn’t always feasible given that there are many restrictions on when and where tickets can be purchased.
Some visa applicants in priority categories, such as those with family immigrant visas or business visas, face longer wait times because of the department’s increased demand. Applicants from countries that have been identified by the Department of State as areas of concern due to threats to U.S. national security may experience longer waits as well.

Pilot program for visa stamp renewals in the U.S.
The pilot program will reportedly make it easier for H and L visa holders to renew the stamps in their passports, as currently they must travel abroad to obtain a visa foil in their passports from a U.S. embassy or consulate. The program is expected to be rolled out later this year and will allow H and L visa holders to renew the stamps in their passports while they are still in the United States. This may make it easier for these individuals as they won’t have to go through the additional hassle of traveling abroad usually required when obtaining a visa stamp in one’s passport.
Supporters of the new consular division argue that it will improve service for both visa applicants and existing holders. They note that the current process can be lengthy and complicated, often requiring applicants to travel to their home country to have their visa renewal application processed. By setting up a new division in Washington, D.C., the DoS will be able to streamline the process and reduce wait times for visa renewals.
Prior to the enactment of the DoS in 2000, visa applicants generally did not need to get a visa stamp at a U.S. embassy or consulate abroad when they went through the change of status process. However, starting with the enactment of the DoS, all visa applicants who go through this process (except for certain diplomatic and other visa applicants) are now required to get a visa stamp at a U.S. embassy or consulate abroad. This is because DHS now considers these kind of changes to be “travel,” which is why the applicant needs proof that he or she changed status in order for DHS to approve his or her entry into the United States.

Recently though, things have seemingly gotten even worse as the average wait time for an appointment has grown to around four weeks, making it difficult for many travelers to get visas in a timely manner.
