LinkedIn to Restrict Targeted Advertising in EU Due to Complaint Regarding Use of Sensitive Data

LinkedIn has confirmed it will no longer allow advertisers to target users based on data gleaned from their participation in LinkedIn Groups. In response to the complaint it received in February, the EC wrote to LinkedIn to request further information on how it might be enabling targeted ads based on sensitive personal data such as race, political allegiances, or sexual orientation. While LinkedIn maintained that it complied with the DSA, the company has now removed the ability for advertisers to “create an advertising audience” in Europe using LinkedIn Group membership data. “We made this change to prevent any misconception that ads to European members could be indirectly targeted based on special categories of data or related profiling categories,” Corrigan wrote on LinkedIn today. LinkedIn will still allow targeted advertising, just not using data garnered from LinkedIn groups.

The report’s top-line conclusion is that platforms’ ad oversight tools are falling short of delivering the intended transparency and democratic accountability in a critical year for elections globally. Judging by the report findings, something similar may be playing out in platforms’ early responses to DSA demands for ads transparency. “Major gaps”They do note there has been some developments since they carried out their transparency tools tests. But, as the report suggests, it’s all too easy for platforms to inject intentional friction into transparency tools, whether by restrictive design or sloppy implementation or both.

Spyware makers are reportedly capable of locating and stealthily infecting specific targets with spyware using banner ads. One of the startups that worked on an ad-based spyware infection system is Intellexa, a European company that develops the Predator spyware. Ad blockers don’t just hide the ads, but rather block the underlying website from loading the ads to begin with. In 2022, the FBI said in a public service announcement to use an ad blocker as an online safety precaution.

Amazon Ordered to Release Advertising Library in the EU

Amazon will have to publish an ads library in EU after allAmazon will have to provide information about the ads running on its platform in a publicly accessible online archive after all, following a decision by the European Union’s highest court Wednesday. Other tech giants designated under the DSA have complied with the ads transparency provision. However, on Wednesday, the Court of Justice of the EU (CJEU) reversed the September decision by the EU General Court to grant Amazon the partial suspension. It is also a win for platform transparency as it will force Amazon to be more open about the ads it displays and monetizes. In a statement following the CJEU decision provided to TechCrunch, and attributed to an Amazon spokesperson, the company said:

“[W]e await feedback from the Irish Data Protection Commission [DPC], our lead data protection regulator in the EU,” he added. While Meta’s compliance with the GDPR is led by the Irish DPC, under the regulation’s one-stop-shop. This structure does not mean the Irish authority gets final say on Meta’s compliance with EU privacy rules, though. In the case of Meta, this has frequently led to objections from other data protection authorities which have landed stiffer enforcements than the DPC originally proposed. So who gets the final say on the GDPR compliance of Meta’s consent mechanism is complex too.

Europe eyes LinkedIn’s use of data for ads in another DSA askMicrosoft-owned professional social network, LinkedIn, is the latest to get a formal request for information (RFI) from the EU. Of specific concern is whether LinkedIn is breaching the DSA’s prohibition on larger platforms’ use of sensitive data for ad targeting. Profiling based on such data to target ads is banned under the law. The DSA also empowers the EU to impose fines for incorrect, incomplete, or misleading information in response to an RFI. LinkedIn isn’t the only platform to be in the EU’s spotlight when it comes to use of data for ads.

Reddit is introducing a new ad format that looks similar to posts made by users on the platform, the company announced on Thursday. The new ad format, called free-form ads, is designed to feel similar to the content that users share with each other in order to help advertisers get maximum engagement. Although the new format may be enticing to advertisers, ads that look like regular posts may not be a welcome addition for users. The company says the new ad format would be a good way to do things like launch a product or introduce a brand to a new audience. Similar to other ads on Reddit, users will be able to differentiate between free-form ads and regular posts through a “Promoted” label displayed next to the company’s name on a post.

It’s been over two years since a key piece of the tracking-ads’ industry’s consent collection apparatus was found to breach European Union’s data protection laws. A simple ‘yes or no’ to ad tracking is as much friction web users should get. Critics dub the whole cynical approach compliance theatre: An attempt by the ad industry to evade data protection law and keep tracking and profiling web users en masse by packaging systematic non-compliance inside an industry standard framework. However action requiring reform of the framework was suspended pending a final court ruling on the IAB’s appeal. Plus the European Data Protection Board is due to weigh in with guidance soon.

Meta Outage Causes Major Disruption: Facebook, Instagram, and Threads Experience Intensive Downtime on Super Tuesday

Reports are coming in that a number of Meta’s top social apps, including Facebook and Instagram, as well as its new app Threads, are all experiencing an outage on Tuesday morning. We’ve reached out to Meta to confirm the timing and the reports and will update if we hear more information. In the meantime, Meta communications director Andy Stone has confirmed the outage in a post on X, noting, “We’re aware people are having trouble accessing our services. To quell its potential role in influencing the elections’ outcome, Meta disables political ads in the timeframe leading up to key elections, like the U.S. midterms. To address newer concerns, Meta also announced it would label political ads with AI-generated imagery for the 2024 election cycle.
