“New Accusations of Privacy Coercion Emerge Against Meta’s EU Data Collection Scheme”

As we’ve reported before Meta’s self-serving ‘consent or cough up’ offer is already facing a number of other GDPR complaints. Today’s complaints are not the first filed against Meta’s consent or pay tactic by consumer protection groups — some of which argue it’s breaching the bloc’s rules on consumer protection, too. However its blog post defending the controversial tactic does not make any mention of how it complies with EU consumer protection law. So another very pertinent question, vis-a-vis Meta’s consent or pay offer in the EU, is what the Commission will do? *The BEUC members filing GDPR complaints against Meta are: CECU, dTest, EKPIZO, Forbrugerrådet Tænk, Forbrukerrådet, Poprad, Spoločnosť ochrany spotrebiteľov (S.O.S.

The company’s iPhone revenue in India jumped 42% year-on-year in 2023 to $8.7 billion, Morgan Stanley wrote in a note on Friday. India’s iPhone business is now larger than any standalone country in the European Union, Morgan Stanley added. This compares to China iPhone shipments, which represented 20% of iPhone shipments and revenue in CY23 (down 1-2 points Y/Y, respectively),” the analysts wrote. The average iPhone sold in India last year had around 260GB of memory, a 26% increase over 2022, Morgan Stanley said. Morgan Stanley estimates the tech giant’s India revenue will reach $40 billion by 2032.

This week, the Financial Times reported the EC will issue its first-ever fine against the tech giant for allegedly breaking EU law over competition in the streaming music market. It reads:We’re happy to support the success of all developers — including Spotify, which is the largest music streaming app in the world. In the case of the EU complaint, the concern is that Apple’s App Store distorts completion in the music streaming market. “There are other rivals to Apple Music — there are Deezer, there are Soundcloud. A rep for the EC declined to comment on news related to Spotify’s complaint or any pending fines.

The European Union is formally investigating TikTok’s compliance with the bloc’s Digital Services Act (DSA), the Commission has announced. Although the EU’s concerns over TikTok’s approach to content governance and safety predate the DSA coming into force on larger platforms. Commenting in a statement, Margrethe Vestager, EVP for digital, said:The safety and well-being of online users in Europe is crucial. The EU may also accept commitments offered by a platform under investigation if they are aimed at fixing the issues identified. In TikTok’s case the platform informed the bloc last year that it had 135.9M monthly active users in the EU.

Uncovering the Details of Apple’s DMA Guidelines: Essential Knowledge for App Developers

App Store 2024 V1 1
Apple last week announced new rules for EU app developers to comply with new regulation, the Digital Markets Act (DMA). Developer responses to the changes have been mixed, as several larger companies, including Epic Games, Spotify and more recently Microsoft, have come out against Apple’s changes, which seemed designed to ensure that Apple’s ability to profit from iPhone apps continues, regardless of how they’re discovered and installed. This fee applies to apps both distributed on the App Store and through alternative marketplaces and is €0.50 for each first annual install per year over a 1 million threshold. After digging through the documents Apple provided and speaking to the company, there are a few caveats and details to these rules that developers should know. We’re compiling them below as a starting point and will add to this list over time as we learn more.

Apple last week announced new rules for EU app developers to comply with new regulation, the Digital Markets Act (DMA). Meanwhile, the company is implementing a Core Technology Fee that Apple says pays for their access to Apple’s proprietary technologies and tools, developer services and support, and platform integrity. This fee applies to apps both distributed on the App Store and through alternative marketplaces and is €0.50 for each first annual install per year over a 1 million threshold. After digging through the documents Apple provided and speaking to the company, there are a few caveats and details to these rules that developers should know. “Apple’s Proposed DMA Compliance Plan Accused of Extortion and Deemed a Ludicrous Charade by Spotify”

On Friday, the streaming music company issued its response to Apple’s new DMA rules, calling the new fees imposed on developers “extortion” and Apple’s compliance plan “a complete and total farce,” that demonstrated the tech giant believes that the rules don’t apply to them. It will also charge a 3% payment processing fee when developers use Apple’s in-app payments instead of their own. Apple’s App Store will maintain its power, Ek believes. Plus, because of the increased fees, Spotify doesn’t even have a choice, Ek explains — it’s forced to stick with the current system. “With our EU Apple install base in the 100 million range, this new tax on downloads and updates could skyrocket our customer acquisition costs, potentially increasing them tenfold.

Spotify Hints at In-App Purchases for EU iPhone Users Prior to DMA Implementation

The new rules prevent “anti-steering” practices, whereby the platform owner — in this case Apple — prevents app developers from informing their users about alternative payment or subscription options. And the DMA also has provisions for preventing gatekeepers from requiring developers to use their own payment services. “For years, even in our own app, Apple had these rules where we couldn’t tell you about offers, how much something costs, or even where or how to buy it. The DMA means that we’ll finally be able to share details about deals, promotions, and better-value payment options in the EU,” Spotify said in a blog post. One where you can see all subscription pricing, promotions or deals, and even make purchases, all seamlessly within the app.

EU Users to Gain Control over Cross-Site Tracking Under Digital Markets Act Enforcement

Meta Announces Subscription Services For Facebook And Instagram
The Digital Markets Act (DMA) applies to just six (mostly US) tech giants, including Meta. The incoming choices will also enable regional users of Facebook Messenger to stop Meta combining their data with their use of its social network. This is the only alternative Meta currently offers EU users who don’t want it to process their information to run tracking ads. And it remains to be seen whether EU data protection regulators will accept it. An ex ante reform of digital competition law in Germany already led to Meta making some concessions over cross-site tracking last June.
